In consideration of the individuals Cynthia Vincent and Carmen Grammer acting in an effort to conduct THeFASHION.CAMP (“Program”) granting myself and child(ren) (“Minor”or “Minors”) the opportunity to participate in THeFASHION.CAMP (“Program”).

I,the undersigned, and the parent/guardian of the minor child listed below (“Minor”) and as the parent/guardian of second minor child listed below (“Minor #2”), am aware that there are certain risks of injury and/or damage inherent in the Program’s activities and this waiver and release will apply to the current and future instances;

I will follow and/or instruct the Minor(s) to abide by all safety rules, policies and regulations and to take reasonable precautions to minimize risks of injury or damage arising from participation in the Program;

I give my consent to have the Minor(s) participate in all aspects of the Program;

I knowingly assume full responsibility for all risks of bodily injury, emotional injury, death or property damage that may occur in relation to myself and/or the Minor as a consequence of participation in the Program at the Program;

I understand that the Program has no obligation to obtain medical treatment for myself and/or the Minor(s). Should it become necessary for I and /or the Minor(s) to have emergency medical care while participating in the Program, I hereby give the Program personnel my permission to use their judgment in obtaining medical care, and I give permission to the medical care provider selected by the Program personnel to render medical care deemed necessary and appropriate;  I understand that the Program at it’s sole option but without obligation may procure insurance to cover part or all of such medical expenses incurred by myself and/or the Minor(s); I understand and agree that any cost incurred for such treatment which is not covered by insurance shall be my sole responsibility;

Parents and Student agree to accept and abide by the program’s COVID-19 policies and protocols, which may be modified from time to time, including but not limited to COVID-19 testing, pre-screening, safety and use of personal protective equipment. Parents’ and students’ failure to comply with the policies and protocols may result in the program denying entrance to the program’s premises, events and activities and/or may result in the Student and/or Parent being asked to leave the program at the sole discretion of the instructors of the program without refund.

I, the undersigned, waive all rights of recovery which the Minor(s) or I have now or in the future, whether known or unknown, against the individuals Cynthia Vincent and Carmen Grammer, or other entities associated with location of Program, its officers, agents, employees and /or personnel, and I release, acquit and forever discharge the individuals Cynthia Vincent and Carmen Grammer, entities associated with location of Program and their personnel from and all liability for any bodily injury, emotional injury, or other personal injury, damage, loss or expense, claims, demands, causes of action, costs, loss of services or use, compensations, debts, monetary damages, including but not limited to attorney fees, which result from or are in any way connected with my and/or the Minor’s participation in the Program or any related activities;

I also authorize the Program and its agents to make, procure and/or use photographs, films, tapes, digital media recordings or other likeness of myself and/or the Minor’s physical image and/or voice as for use with the Program’s publicity, marketing and/or advertising materials;

I have read this agreement and I understand what it means to my legal rights and my and/or the Minors participation and my signature is made of my own free will and act;

I agree to abide by the rules and policies set forth in this registration and waiver release forms;

COVID-19 policies and protocols:

Students and instructors must be free from: fever ≥ 100.4○F; new cough, new loss of taste or smell, difficulty breathing, diarrhea or vomiting as well as a recent exposure to confirmed case of COVID-19 or other known symptoms of COVID-19.

A temperature check may be completed at the site prior to the start of the program’s activities.

Students must wear a mask indoors when requested and thoroughly wash hands upon arrival and before returning to the program space after lunch.

Hand sanitizer effective against COVID-19 is available to all attendees and instructors.

Program indoor space is cleaned prior to and immediately at the end of each daily session.

I agree to be legally bound by signing this registration and waiver release forms and extend this binding to the Minor(s) and/or myself as a program participant.

COVID-19 Liability Waiver

I agree that if myself or my child is exhibiting symptoms of respiratory illness, a fever of 100 degrees or higher, or any other known symptoms of COVID-19, myself or my child will not attend or return to THeFASHION.CAMP until my self or my child has satisfied the policy to return to THeFASHION.CAMP after exhibiting symptoms of COVD-19. I agree that I will immediately inform THeFASHION.CAMP if I or my child tests positive for COVID-19 or has been exposed to anyone who has tested positive for COVID-19 in the prior 10 days.

By signing this agreement,  I acknowledge the contagious nature of COVID-19, the fact that it can be difficult to identify, and the inherent risks of my child and I being exposed at the location of THeFASHION.CAMP to those who may be infected with COVID-19, including employees, agents, contractors, volunteers, guests and other students. I voluntarily assume the risk that my child or I may be exposed to or infected by COVID-19 by entering the premises and that such exposure or infection may result in personal injury, serious illness, permanent disability, and/or even death. I further acknowledge that children who become infected with COVID-19 may later develop MIS-C and I assume this risk.

I voluntarily assume full responsibility for myself and my child for any and all risks of illness, injury, disability or death associated with exposure to COVID-19, as well as from use of any protective equipment, including but not limited to face masks that the program may voluntarily provide.

To the fullest extent permitted by law, I completely absolve, release, and waive any potential claims I or my child may have against THeFASHION.CAMP, it’s directors, employees, contractors, agents and volunteers (“Released Parties”) including, but not limited to, claims for personal injury, disability, illness, damage or death from exposure to COVID-19, whether such exposure occurs during or after my attendance of THeFASHION.CAMP programming or events.  Also, I agree, on behalf of myself, my personal representatives and heirs, not to make any type of legal or equitable claim arising from my or my child’s exposure to COVID-19, against Released Parties, whether or not it arises through the negligence, omission, or default of Released Parties or a student or program participant. Further agree that if any such claim is made against the Released Parties, I will indemnify and defend the Released Parties with respect to any such claim. Such duty of defense shall arise immediately upon tender.

I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I MAY BE WAIVING CERTAIN LEGAL RIGHTS OF MYSELF AND MY CHILD, INCLUDING THE RIGHT TO SUE. THIS AGREEMENT SHALL BE BINDING UPON ME AND MY HEIRS, MY CHILD, LEGAL REPRESENTATIVES, AND ASSIGNS, AND SHALL INURE TO THE BENEFIT OF THeFASHION.CAMP AND THEIR SUCCESSORS AND ASSIGNS.
